The 'Dog-ma' Police (Animal Control) MUST give you the law.

GLENWOOD, Iowa, May 22 (NationalDogPress.com) --

I have a question as an Independent Investigative Reporter, about 'Animal Control' officers, also known as, the 'Dog-ma' Police in many parts of this country.

Who's best to judge the 'actual' condition of a dog, cat or pet in a criminal allegation complaint process; the 'Dog-ma' Police, an unfamiliar veterinarian, or the citizen owner of the 'dog' or pet in question?

Additionally the question begs for answers to differ in alleged accounts of the 'Dog-ma Police' allegedly overstepping their bounds of authority in demanding a dog owner to be 'forced' to 'put down' via euthanasia of their 'old aged' family pet or face criminal animal cruelty and abuse charges. Now to a citizen being challenged as a criminal with such a questionable act of alleged authority from the 'Dog-ma' Police, what is a person to do? Well I will tell you. I don't have a specific legal authority* but as an Independent Investigative Reporter having researched these issues, I can give you some very good 'common sense' advice that may benefit anyone facing the above listed questions, and the 'Dog-ma' Police information as follows:

Hypothesis of the 'Dog-ma' Police in Animal Control:

Have you been accused of neglect or cruelty towards an animal? The rights of animals are protected and they are afforded the same humane treatment and protection from exploitation and abuse that humans are. Cruelty to animals is actually considered one of the three main components of the MacDonald Triad. This system was developed in 1963 in order to find personality traits within an individual that can lead to more violent crimes against society.

Signs of abuse that may lead to allegations of abuse, cruelty or neglect against your 'old aged' pet:

- Signs of malnutrition
- Dog fighting
- Untreated wounds or injuries
- Lack of protection or shelter from the weather
- Owner shows lack of concern for animal well-being
- Ignored health problems
- Bruises, fractures, eye injuries
- Sanitary living environment
- Abnormally subdued and frightened behavior by animal

The main categories of animal cruelty are broken down into two groups; Passive cruelty (Acts of Omission) and Active cruelty (Acts of Commission). Passive cruelty is recognized as a crime based on the lack of attention given to the animal. This can stem from starvation, dehydration, lack of shelter from weather conditions etc. When pertaining to active cruelty the situation is much more violent. It is the deliberate intent to torture and cause harm to an animal. People who fall into this category are typically considered for psychological evaluation.

If you are being accused of and investigated for committing acts of abuse and/or neglect against an animal, you will need to speak with an experienced criminal defense lawyer that can legally advise you on the statutes and law pertaining to charges that have been placed against you. A knowledgeable lawyer will be able to represent your legal rights.

Animal Control and Your Rights:

Every person has the right to protect any one of his rights which he feels has been violated. In defending himself against the tyranny of government, no matter how slight, he is preserving the rights of all of us, usually at great cost in money, effort and time. How do we defend these rights? The first step is knowing what those rights are.

Be sure to know your local ordinances on animal control. You can gain these at your local library and/or the city/county clerks office. Read them, understand them, and you could even go as far as checking the constitutionality of them. Such as, do they provide for a hearing before seizure? One of our basic constitutional rights is the right of "Due Process" under the 14th amendment.

"No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

Also check their authority given by the city and state. Your animals are considered "property" under the law and that includes all the rights that come with personal property. Along with protection from unreasonable search/seizure under the sixth amendment. Be sure you understand your basic rights under the United States Constitution. These basic rights can not be over written by any state or city codes. Another thing to look at is State codes, and the State constitution. It's far easier to know what to do in an emergency situation if you are current on the issues. When animal control is standing at your door, IS NOT the time to catch up on current events.

Even though there may not be any ordinances against or restrictions of your 'Old Aged" dog, does NOT mean they won't try to take your animals. Unfortunately, animal control officers around the U.S. generally take only a short course before being given the typically low paying job. These people are not versed in

the law or civil rights, heck most of them are not even trained in animal welfare, only in perverted 'Animal Activist Rights.'

They will many times tell you that they are the law and they can do what they want! WRONG, they have been given only so much authority given to them in the city/county statutes. This is called their statutory authority, ask for it at what ever they try to do. Stepping beyond their statutory authority makes them become personally liable for their actions. Many city's have adopted codes of conduct for their officers that state they shall not step beyond their authority. These codes are designed to protect the city from an officer stepping beyond their statutory authority. So in essence the city will not backup an officer that steps beyond their authority and in all likelihood would also file charges against the officer in order to protect it's own butt.

Breed specific legislation (BSL) desires to outlaw the Pit Bull dog appearing breed type or look, by various Metro media types are best defined 'pushing a DOG BREED HATE AGENDA, described as discriminative restrictions placed on innocent animals and owners based on the appearance or breed of the animal. No matter how friendly, well trained or useful a dog is, if the animal fits a specific description of a desired BSL "banned" breed, such as the pit bull dog it will face cruel restrictions, banishment or even death in jurisdictions with BSL.

More loosely, a desire for an agenda of legislation to get BSL covers any type of discrimination against a dog breed or breeds. Example, PetSmart allegedly discriminates against several dog breeds by refusing entry to their "day cares". This sends a very poor message to the public that these breeds need to be treated "differently" than other dogs. In truth, if PetSmart trainers were skilled, they would be able to determine each dog of every breed's level of dog aggression on a case by case basis.

Each discriminating act portrayed by main stream media, is a brick in the wall of anti-dog sentiment, now targeted by many main stream media and newspapers that has a direct effect upon all breeds of dogs, not just pit bulls.

Case and Point:

On or about 20 May 08, the Omaha World Herald, a primary main stream newspaper for Omaha, Nebraska allegedly published a Texas based article of a fatal attack by a pit bull on a 7 year old child that happened in Texas, however, the article allegedly appeared to look like the dog attack had occurred locally in Omaha, Nebraska, by it's article publishing in Omaha main stream media.

On 21 MAY 08, the Omaha World Herald cartoon author named KOTERBA, published a cartoon in the same main stream Omaha, NE. newspaper depicting a MAD and VIOLENT looking, crazy eyed (eyeball popping out) looking cartoon pit bull carrying a bleeding human arm ripped off a human torso running past a little child standing behind a female grown up.

The cartoon caption read, with the female grown up person stating, "But Gingersnap is SUCH A GOOD Pit Bull." "See how she plays FETCH?" The cartoon depicted the little child hiding behind the female grownup stating the above caption, displaying the child in complete fear.

MY 'MAD COW' Moment, occurred, when I observed this flagrant irresponsible display and portrayal of many thousands of good, innocent and responsible Pit Bull dogs and Dog Owners, being "targeted' for BSL legislation by a main stream newspaper in Omaha, Nebraska 'pushing' tragedy's that occurred in Texas, however, they were allegedly made to stir HATE MONGERING MANIA in the Omaha, Nebraska Metro area against a dog breed that has essentially no bad reputation in Omaha, that can be proven as deadly against humans, in any recent event or incident in Omaha, Nebraska.

Additionally, following the release of the initial Texas article of a Pit Bull assault that actually occurred in Texas, a documented incident of an innocent loving family Pit Bull was intentionally POISONED in the well fenced yard of an Omaha, Nebraska responsible dog owner. The respected resident, in the Florence district area of Omaha, NE. took their dog to a vet. who determined that the innocent loving Pit Bull was poisoned with an unknown type of rat poison. The only apparent reason that can be assessed, is a vigilante assault to kill any pit bull based upon the fraudulent looking Omaha, Nebraska article made to look like a deadly attack occurred in Omaha, NE., followed by a cartoon portraying the same agenda of MAD killer Pit Bulls on children, and excused by the adults calling their dogs baby names.

This alleged Animal Rights BSL desired agenda by the Omaha, Nebraska Main Stream press is appalling at minimum, and evil at worst in their alleged agenda to create panic and mania in Omaha, Nebraska against a good dog breed and innocent peaceful family dogs.

Need I say more? I am Da*n MAD as a 'Mad Cow' in my moment of reading this fraudulent Dog Breed Attack cartoon where no deadly dog attack occurred. Omaha, Nebraska should be outraged by this alleged BSL agenda behavior by it's Metro main stream media. I know I AM.

God bless good innocent dogs and their responsible owners of all dog breeds.

ALWAYS, always, always:

Keep your gate's locked and if there is a lot of play between the gate latch and the pole, chained also. This will prevent anyone from trespassing on your land and possibly opening your gate and releasing/taking your animals.

Above all, don't answer any questions unless you HAVE to and don't answer beyond the minimum without first obtaining some qualified legal advice (from an Attorney).

Always ask for their 'Animal Control' statutory authority for anything they want to do. (An example would be the case in West Hartford, Conn. where the Animal Control Officer allegedly demanded euthanasia of an old age dog named Bambi or the owner would be charged with criminal animal abuse, ref: several articles in the HartfordAdvocate.com (see below listed article reference link at end of page).

There have been numerous similar cases where there was none (no statutory authority for animal control). The person was told the law exists because I (the 'Dog-ma' Police) say it does. They MUST show you the statute.

If they try to seize your animal be sure to request their statutory authority to do so:

Many times it says they only have the right to seize an animal on the owners property if it is injured or obviously abused. If it's not spelled out in the statute they have no right to seize your animal and are stepping beyond their authority and become personally liable for their actions. Most cities in most states have a 'code of conduct' that prohibit employee's from stepping beyond their authority.

If they are looking for something, they MUST have a search warrant. Demand to see a copy.

They may threaten to arrest you for obstruction of justice. Don't fall for it, until they can provide you with their statutory authority for whatever they want to do, you are not obstructing justice and only standing up for your rights. You may have to explain to them that you are not obstructing justice and you will comply with their wishes as soon as they can either come up with their statutory authority or a court order. Be polite but firm.

Another one they may try you with is "We'll just take it as a vicious animal." Again ask for the statutes, in most cities, animals must first be deemed "vicious" in a court of law.

Don't fall for the "We'll show you the statute when we take your animal to the pound." Once they gain possession, they can in many cities and states, 'put your animal down' in 3 days in many cases. In some cities, they can 'put down' an animal immediately if they consider it wild or not properly vaccinated from rabies. They only way to prevent it from happening would be to file an injunction against it. Only release your animals to them upon proper statutory authority or a court order.

Above all 'Stand firm' and always 'Stand your ground' if your are innocent:

If they continue, call the sheriff, or if it is the sheriff, call the mayor and ask to have them arrested. If you can't do that, then warn them they are stepping outside of their official capacity and become personally liable should anything happen to your dog. Always have an Attorney's name, address and phone number to defend you and your Rights, before it is needed. Even to defend your pets and your Rights to them when they get old in age.

Bottom line though, The 'Dog-ma' Police (Animal Control) MUST give you the law.

Remember when they violate their oath of office to support, uphold and defend the constitution, then they make themselves personally liable for any detriment to you.

Conspiracy to deprive one of one's rights in is a very serious crime:

Title 42, United States Code section 1983 states that "every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State . . ., subjects, or causes to be subjected, any citizen of the United States . . . to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress."

In Summary of Animal Control and Your Rights:

I Say: 'Be there, for every animal owner." Especially for your own Dog, cat or pet. If not you, then who?

Dogs have never been more a part of our lives than they are today. Even though nearly 45 million American homes have at least one canine family member, dogs are being forced out of their homes by various animal rights legislations, out of entire communities, in fact, in ever-increasing numbers.
Headlines suggest that the problem is a rash of attacks by dangerous dogs, however this article's information contend that the headlines fail to tell the whole story. For a real example, Denver, CO. has one of the toughest pit bull bans in the country. Some 2,000 pit bulls were put to death there last year because of it. Around the country, banning pit bulls has become the popular answer to the dangerous-dog question. Many states and the municipalities within them have jumped on the animal rights dog 'ban' wagon.

How's that for scary? Are you as a responsible owner, of one of these dog breeds wide awake now? How about just owning a dog that looks like one of these banned dog breeds? The number of breeds already deemed dangerous should be enough to make any dog owner dizzy. But the proliferation of breed-specific legislation that sparked the Dangerous Dog Summit also includes bans on any mixes thereof. And on any dogs of a certain size.

In Fairfield, Iowa, for example, any dog over 100 pounds is subject to regulations. By definition alone, that would include such breeds as the borzoi, the Great Pyrenees, the Newfoundland and the St. Bernard. Some dogs that have caused serious injury have managed to escape the bans  for now.
Last year, there were 26 human fatalities from dog bite injuries. It's unclear how many serious bite injuries dogs inflict each year, but estimates based on the last major study of cases treated in hospital emergency rooms puts the number at around 334,000.

Children under 10, the main victims of dog bites, are two times more likely to drown in a five-gallon bucket and 11/2 times more likely to die from injuries caused by playground equipment than they are to die from a dog attack. Some figures from the National Highway Traffic Safety Administration also may help put the dog-bite situation into perspective: Between 1997 and 2002 in Colorado, one child was killed by a dog. Between 1997 and 2002 in the United States, one child was killed in an alcohol-related motor-vehicle accident every day. If we have dangerous-dog problem in specific areas it is because twenty-five percent of dogs involved in fatal attacks are chained or otherwise confined. Others are poorly trained or poorly handled guard dogs. Or macho status symbols for young gangbangers. Some are victims of domestic violence.

Chained dogs are also 'not' the problem:

Many poorly thought out, inappropriate and misguided "tethering" laws are being proposed around the country. These restrictive 'tethering' laws would be in many breed types, inappropriate in a dog's proper care with any responsible dog owner. Many performance dogs PREFER to be outside and are best chained - for their own protection. Experts in proper dog care performance have found that dogs that are permitted to roam freely are more apt to join up with other free roaming dogs and attack. Of course, there are those that are chained "just because" and not well cared for to begin with. Some call them 'junk-yard' dogs.

Breed bans are an emotional response to unfortunate incidents:

They're a response to dog attack fear, not to facts. All dogs bite, and all can potentially cause serious injuries. No scientific studies have proven that one breed bites more than any other.

Existing animal-control laws aren't properly enforced. If they were, many of the problems related to dangerous dogs, mistreated/handled junk-yard dog-chained dogs, or dogs running loose  would be lessened. When animal control targets 'petty' animal rights issues for criminal action, they are taking away serious potential to stop actual dangerous dog situations, caused by the poor quality handling/training in the owners.

When breeds are banned:

The irresponsible dog owners will continue to ignore the laws, or turn to other breeds, re-creating the problem. Shelter systems and animal-control 'claim' they may not be able to handle all the surplus animals. Actually the facts are disclosing animal shelter/rescue destructive practices to sustain a 'pet-overpopulation' in order to seek more animal control funding and donations. Studies have shown that animal-control officers cannot identify "pit bull terriers" beyond a reasonable doubt and have miss-identified dogs that did not look like a pit bull, even if it was 50 percent pit bull; yet the dog was not considered a pit bull. But if a dog 'looked' like a pit, it was considered a pit, no matter what the percentage of the breed.

One thing that always stands out to the 'Animals C.L.U.B.- Freedom' National Organization about dogs throughout history is that they are an entirely responsive species. This Investigative Reporter notes that "we can breed them and train them to be any way we want them to be. All they want to do is please us. If we want them to herd, they'll do it. If we want them to just cozy up with us on the sofa, they'll do that. So if we ask them to become aggressive and violent, either intentionally or through irresponsibility, they will."

The dogs aren't the bad guys. People are. The dogs are the victims, not just of irresponsible breeders and owners but of the violence that pervades our whole society.

On one level the dangerous dog prevention measures need to be about restoring the family image of the bully breeds. About objecting to the breed-specific laws that threaten to deprive dog owners of their animals and about turning pet owners and breeders into responsible animal property owners.

But at a deeper level, it's about ending the cycle of violence by starting a campaign of kindness.
I Say: 'A man's religion of ownership is not worth it's salt, if his dogs are not the better for it.'
